HMRC issues updated Registration Notice MLR9 and announces registration dates
The anticipated announcement of the publication by HMRC of the updated Registration Notice MLR9 and the registration dates was made on 31 July 2008.
NOTE: ACCA members holding a practising certificate and whose firms are regulated by ACCA [i.e. where control is exercised by members holding ACCA general or auditing practising certificates] will continue to be supervised by ACCA under the Money Laundering Regulations 2007 (NMLR). This supervision will extend to other entities under the same ownership through which members operate and which are subject to the Money Laundering Regulations 2007. Members will therefore need to ensure that all such firms, including firms only providing payroll and/or book-keeping services and/or acting as Trust and Company Service Providers (TCSPs) have been registered with ACCA.
HMRC’s registration requirements for Accountancy Service Providers (ASPs) and Trust or Company Service Providers (TCSPs) who are not supervised by another supervisory authority, for example ACCA, are:
Registration as an ASP
ASPS already in business must be registered with HMRC before the 1 January 2009. In order for HMRC to be able to process applications on time, completed application forms must be sent to HMRC with the appropriate registration fees by 30 September 2008. New ASPs must be registered with HMRC before 1 January 2009.
Registration as a TCSP
You should register with HMRC before 30 September 2008. Failure to apply in time may result a civil penalty if the relevant activity is being carried on. Those setting up a new TCSP will need to register prior to carrying on that business. For TCSPs and ASPs who have already applied to register with HMRC and who may be affected by the updated guidance:
- HMRC will write to you asking you to check the guidance and let them know whether you still need to register
- the letter will explain what you need to do
- if you have not received a letter by 19 August the you should phone the HMRC helpline on 0845 010 9000.
